TERMS & CONDITIONS

Please read these Terms and Conditions carefully before booking or attending any classes with Jaykays Dance Company Limited. By booking a class, trial, or membership with us, you agree to the following terms.

1. ABOUT US

Throughout these Terms and Conditions:

“We”, “Us”, “Our” refers to Jaykays Dance Company Limited.

“You”, “Parent”, or “Customer” refers to the person booking or paying for classes.

2. PAYMENT

a. Fees are collected by our direct debit provider GoCardless. Fees are calculated across 38 weeks of the year and divided into 12 equal monthly payments. You will receive an email in advance of payment from GoCardless to notify you that payment is due for collection on the 15th of each month. Payments will appear on your bank statement as: GoCardless Ref: Jaykays Dance. Your monthly recurring payment can be viewed in the Customer Portal.

b. Please note that GoCardless is our only payment method at Jaykays Dance Company. Cash, cheques and bank transfers are not accepted.

c. Fees must be paid in full despite any missed sessions for reasons such as illness and injury, holidays, and other commitments.

d. Any additional costs for events such as exams and shows will be sent out as an invoice via email. Payment for these additional costs will be collected by our direct debit provider GoCardless. These invoices can be viewed in the Customer Portal.

e. Any failed payments will automatically be set to re-collect. If the payment fails again then we will be in touch to arrange how to collect the outstanding payment. To make any arrangements regarding payments please contact our finance administrator at admin@jaykaysdancecompany.co.uk

f. If payments continue to fail an admin fee will be charged to your next payment, and students may not be able to attend until any outstanding monies owed has been settled.

g. For each sibling coming at full price the lowest paying sibling will come for 10% (eg. If there are 3 siblings 2 will be full price and 1 will be at 10%)

h. Please note that you cannot pay as you go. Jaykays offers a 2-WEEK-£10-TRIAL to try before you buy and then fees must be paid in full after this trial.

3. ENROLMENT & CANCELLATION

a. If you wish to stop your classes with Jaykays please give us 4 weeks’ notice in writing. Payment will still be required for 4 weeks from date of notification. Students can continue to attend during this period. You will then be deactivated as a customer in-line with our privacy policy.

b. If you would like to amend your current classes by adding on new classes or stopping a class, please give us 4 weeks’ notice in writing. We will amend your GoCardless payment accordingly.

c. If classes must be cancelled by the venue or teacher for any reason, a replacement class will be offered as an alternative, which may occur on a different day or time. We regret that we cannot refund you if you cannot attend the replacement class.

d. If a teacher is unable to teach their usual class for any reason, Jaykays Dance Company will provide a cover teacher to deliver the class who meets the requirements outlined in our safeguarding policy and as part of our Council for Dance and Musical Theatre (CDMT) recognised school status.

e. If classes must be cancelled due to a pandemic, then payment will be collected as normal, and classes will be delivered by Zoom.

f. Please note that we operate an automatic re-enrolment system where we always assume that every student will continue with their current class unless we hear otherwise in-line with Section

2a. Therefore, there is no re-enrolment process. We will collect payment accordingly unless you have informed us that you will not be returning.

4. CODE OF CONDUCT

a. We are not responsible for any valuables students bring to class. We advise not to bring mobile phones or tablets into class. If they are brought into class, they should be switched off or put on silent. Teachers may collect devices in at the start of a lesson to avoid distraction.

b. Disruptive behaviour will not be accepted. Students will be asked not to participate if this sort of behaviour is displayed, and parents will be contacted in-line with our behaviour policy.

c. We have a zero-tolerance policy on bullying.

d. The Jaykays teaching team is only responsible for students during their stated class times, so please do not drop them off early, leave them unsupervised or collect late.

e. If your class is the first class of the day, please do not enter the venue early. The doors will be closed, locked, and opened 5 minutes before class time.

f. Please inform us of any changes to your personal circumstances i.e. change of address, email address, phone number, parental responsibility etc. You can update this information independently in the Customer Portal.

g. We will not tolerate any rude or violent behaviour from parents or the adults that drop off or collect students from classes. You will be asked to leave the premises.

h. Please do not hold a teacher’s attention for a long period of time before or after class. Their responsibility is to be in the classroom to supervise and lead. If you need to contact your class teacher, please do via email, or book in for a teacher feedback call when they come up at the end of each term.

i. If you contact the Jaykays teaching team during unreasonable hours, please note that they will not respond until a more appropriate time. Please be aware that contacting during unreasonable times also runs the risk of your message being missed, so please do be mindful at the times you are making contact.

j. Please contact the Jaykays teaching team via email or use the teacher feedback calls when they come up at the end of each term. Messages sent via the business or personal social media channels or text message run the risk of being un-read and lost.

k. If your child is attending classes at another dance school in the local area, please do let us know. It is important that we are aware in case there are any clashes of interest such as contrasting teaching methods, representing multiple clubs at the same events, or being entered for the same examinations.

l. If you wish to make a complaint, then please use the complaints procedure to follow and understand the process.

5. HEALTH & SAFETY

a. Parents should alert teachers to any injuries or illnesses that may affect a student’s performance in class.

b. Please do not send your child to class if they are displaying any symptoms of contagious illnesses such as vomiting, diarrhoea, chicken pox etc.

c. Long hair must be tied back ideally in a classical ballet bun. Jewellery and watches must not be worn. The Jaykays teaching team may ask students to tie long hair up or remove jewellery in-line with our uniform guide and Jaykays Commandments.

d. Students should wear regulation uniform and footwear to class. Please refer to the Jaykays Dance Company uniform guide.

e. Please ensure you declare any additional needs or mental health diagnosis in your enrolment. If you have a change of circumstance that has developed in this area, please do inform us, and update the Customer Portal.

f. The Jaykays teaching team are all first aid trained and will take the necessary actions required in accordance with our training.

g. The Jaykays teaching team are all trained in safeguarding children and will take the necessary actions required in line with our safeguarding policy.

h. The Jaykays teaching team may need to physically contact students to aid learning, particularly in Acro where we need to spot them. The teaching team at Jaykays are all in possession of a fully enhanced DBS check and have completed the appropriate training in-line with our safeguarding policy and CDMT recognised school status.

i. Please note that by enrolling into classes at Jaykays Dance Company you are accepting the element of risk involved with this physical activity. We have risk assessments in place to keep dancers safe however, we will not be liable for any direct or indirect loss, damage or injury that may arise in connection with the activities delivered at Jaykays Dance Company, in-line with our safe studio waiver.

6. SOCIAL MEDIA

a. It is strictly prohibited to post or share information of a personal nature about any members of staff or Jaykays Dance Company students. In doing so legal action will be sought.

b. It is prohibited to share any false information or negative comments that could compromise or damage the company’s reputation. In doing so legal action will be sought.

c. Students and parents must not post or share photographs of other students without consent. Videos recorded in class are to be used as a teaching aid only and not shared on social media.

d. The Jaykays teaching team will not accept “friend requests” from any students under the age of 18 years old. They will not reply to any message students send via private message. They are always welcome to approach teachers in class time with any questions or concerns.

e. Jaykays Dance Company has the parental consent and owns the rights of any photos shared on its social media pages or advertising. Please ensure you make us aware if you ever decide to withdraw this consent. You can do this independently in the Customer Portal.

f. The Jaykays Dance Company social media channels are not platforms to feature students. They are platforms to promote Jaykays Dance Company, to share our stories and our values.

7. Governing Law

These Terms and Conditions are governed by the laws of England and Wales.

Any disputes will be subject to the jurisdiction of the courts of England and Wales.
